Terms of Service

1. Description of service

WA Web Pro is a Chrome browser extension that adds privacy and customization features to WhatsApp Web (https://web.whatsapp.com), including:

• Privacy features (e.g. screen lock, blur effects for messages and contacts, lock-after-idle)
• Customization (e.g. themes, shortcuts for quick chat, contact info, pinned contacts)
• Optional features (e.g. in-chat translation via Google Translate, optional usage analytics)

The Extension runs only when you use WhatsApp Web in a supported browser. We do not operate, control, or endorse WhatsApp, and we are not affiliated with WhatsApp, Meta, or their affiliates.

2. Eligibility

You must be at least 13 years of age (or the minimum age required in your jurisdiction to use online services) and able to form a binding agreement. Use of WhatsApp is subject to WhatsApp's own terms and age requirements; you are responsible for complying with them. By using the Extension, you represent that you meet these requirements and that your use will comply with all applicable laws.

3. Acceptable use

You agree to use the Extension and the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Extension or the Site in any way that violates any applicable law, regulation, or third-party terms (including WhatsApp's Terms of Service and Acceptable Use Policy).
• Use the Extension to abuse, harass, defame, spam, or harm others, or to distribute malware or illegal content.
• Reverse engineer, decompile, disassemble, or attempt to derive source code from the Extension (except to the extent permitted by applicable law or the Extension's open-source license).
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices in the Extension or on the Site.
• Use the Extension or the Site to collect or harvest personal information about others without their consent, or to send unsolicited communications.
• Use automated means (e.g. bots, scripts) to access or use the Extension or the Site in a way that could harm, overload, or impair our or third parties' systems, except as we explicitly allow.

We may suspend or terminate your access to the Extension or the Site if we reasonably believe you have violated these Terms or applicable law.

4. Your responsibility

• You are responsible for keeping your lock screen password secure. We are not liable for unauthorized access to your device or your WhatsApp account.
• You are responsible for your use of WhatsApp and for complying with WhatsApp's terms. We do not control WhatsApp's availability, features, or policies.
• Use of optional features (e.g. translation, analytics) may involve third-party services (e.g. Google). Your use of those features is subject to the relevant third-party terms and privacy policies.

5. Disclaimer of warranties

THE EXTENSION AND THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE EXTENSION OR THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT CONTROL WHATSAPP OR THIRD-PARTY SERVICES; WE ARE NOT RESPONSIBLE FOR THEIR AVAILABILITY, ACCURACY, OR CONTENT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

6. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WA WEB PRO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE EXTENSION OR THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE EXTENSION OR THE SITE EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR, IF YOU PAID NOTHING, ONE HUNDRED UNITED STATES DOLLARS (USD 100) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY AT THE TIME OF THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

7. Indemnification

You agree to indemnify, defend, and hold harmless WA Web Pro and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Extension or the Site, (b) your violation of these Terms or any applicable law, or (c) your violation of any third-party rights (including intellectual property or privacy rights).

8. Intellectual property

The Extension and the Site, including their design, code, text, graphics, and logos (excluding third-party content and open-source components), are owned by or licensed to us. Subject to your compliance with these Terms and any applicable open-source licenses, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Extension and the Site for your personal, non-commercial use. You do not acquire any ownership rights. Our name, logo, and related marks are our trademarks; you may not use them without our prior written consent.

9. Termination

• You may stop using the Extension at any time by disabling or uninstalling it. Uninstalling will remove locally stored data.
• We may modify, suspend, or discontinue the Extension or the Site (or any part thereof) at any time, with or without notice. We may also terminate or restrict your access if we believe you have violated these Terms.
• Sections that by their nature should survive (including Sections 5, 6, 7, 8, 10, and 11) will survive termination.

10. Changes to the Terms

We may update these Terms from time to time. The "Last updated" date at the top will be revised. We may notify you of material changes by posting the new Terms on the Site or through the Extension or the Chrome Web Store listing. Your continued use of the Extension or the Site after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Extension and the Site.

11. General

• Entire agreement: These Terms, together with our Privacy Policy and any other policies we publish, constitute the entire agreement between you and us regarding the Extension and the Site.
• Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.
• Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
• Governing law: These Terms are governed by the applicable laws of your country of residence, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Extension shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction in your country of residence, except where your local law requires otherwise or permits you to bring proceedings in another jurisdiction.
• No agency: Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.
